Terms and Conditions for Autopay
PayByPhone Technologies Inc. or one of its subsidiaries with whom you open your Account (“PayByPhone”) allows you, as a holder of an Account, to use Autopay at participating parking facilities. This agreement governs your use of Autopay with PayByPhone.
If you enroll in or use Autopay in a country other than the one from which you opened your Account, you will also have a contract, with respect to your use of Autopay in that country only, with the PayByPhone entity listed for that country in the Terms and Conditions.
By enrolling in or using Autopay, you agree to be legally bound by this agreement and any breach by you of these terms may result in termination of your participation in Autopay.
Please read this agreement carefully and keep a copy for future reference. This agreement is in addition to the PayByPhone Terms and Conditions, Stored Credentials Agreement and any terms and conditions applicable to additional services. In the event of any conflict between the general Terms and Conditions and this Agreement, the terms of this Agreement shall govern.
1. General
In this Agreement, capitalized terms shall have the same meanings as the defined terms in the Terms and Conditions.
2. Autopay Service
PayByPhone offers Autopay at certain access-controlled parking facilities and allows for Parking Session payment to be automatically calculated based on the time of entry and exit of the registered vehicle from the parking facility and collected from the Payment Method associated with your Autopay enrollment. To use Autopay, you must hold an Account with PayByPhone and complete registration for your selected vehicle(s) at selected Facilities Operators that offer Autopay.
At the Autopay-enabled parking facility, on the basis of Automatic Number Plate Recognition (ANPR) or other vehicle tracking technologies and equipment, your registered vehicle is identified as authorised to park and you may be granted access to the facility without having to perform any action normally required to remove a barrier to entry. Your entrance and exit from the participating parking facility, the length of Parking Session and the cost of the Parking Session are automatically recorded for the purposes of initiating payment.
In the event that your vehicle is registered (by you or another party) with both PayByPhone and other mobile parking payment providers offering automatic payment service at the same parking facility, you acknowledge and agree that your parking session may not be started and paid for with PayByPhone and may instead be started and paid for with another provider.
You understand that your use of Autopay is subject to the rules, policies and terms of the relevant Facilities Operator and that the Facilities Operator is responsible for the ANPR and other vehicle tracking technologies and equipment. You acknowledge that PayByPhone relies on the Facilities Operator’s records, including applicable parking fee, time of entrance and exit from the parking facility as conclusive evidence and that you are solely responsible for resolving with the Facilities Operator any disputes, including those relating to times of entrance and exit, as well as any system outage or failure in the ANPR or other vehicle tracking technologies and equipment.
You agree to ensure that your vehicle plate is clean, intact and otherwise in a readable condition when your vehicle enters and exits the participating parking facility offering Autopay.
3. Registration
At any time within the App, you can opt in to Autopay at participating parking facilities. You must select the relevant Facilities Operator, provide a valid Payment Method, and select your authorised vehicle. Unless we state otherwise during registration, your enroIment of a vehicle in Autopay for a Facilities Operator applies to all participating parking facilities of that operator in all countries where Autopay service for the Facilities Operator is available. If you wish to opt more than one vehicle into Autopay at a participating Facilities Operator, you must complete Autopay registration for each vehicle.
You can opt out of Autopay for each vehicle registered for each Facilities Operator within the App. You acknowledge that you remain responsible for any outstanding payment for any Transactions through Autopay prior to such opt out.
If you are no longer the authorised user of your registered vehicle or otherwise wish to deactivate registration of your registered vehicle, you MUST take action to opt out such vehicle for each Facilities Operator in the App. Until you do so, all payments for parking sessions of the registered vehicle at the parking locations of the Facilities Operator will be charged to your Payment Method and you remain responsible for all Transactions prior to opt out. You must notify us immediately if you are unable to opt out your registered vehicle.
4. Availability
By opting in your vehicle for Autopay with a participating Facilities Operator, you acknowledge and agree that this does not guarantee your use of Autopay for all parking locations that may be operated by such Facilities Operator. Please refer to Autopay FAQs for the most up-to-date list of eligible parking locations supporting Autopay.
PayByPhone reserves the right to add or remove any and all parking facilities offering Autopay without notice.
5. Fees and Payment
To use Autopay, you must store valid Card Credentials and comply with the terms of the Stored Credentials Agreement.
You agree that you may be charged an applicable service charge for each Autopay Transaction in addition to any parking fees. The amount of any service charge for each Facilities Operator shall be displayed on Autopay FAQs. We may add, remove or update any service charge at any time.
In the event of a failed Transaction, you are responsible for immediately remediating payment as directed in the App. You agree that PayByPhone may charge you an additional fee in the event that we fail to collect payment in relation to your use of Autopay. We may suspend your Autopay registration for your vehicle(s) until you successfully process your outstanding Transaction.
6. QR Code
As part of the Autopay service and with respect to parking sessions started and paid for with PayByPhone, PayByPhone may offer a QR code to allow you to enter or exit the participating parking facility. You are responsible for protecting any QR code provided and preventing the QR code from being misused.
